Terms & Conditions


These Terms & Conditions (“Terms”), together with our Privacy Policy and Delivery & Returns Policy, set out the basis on which GATHER Fragrance & Lifestyle Ltd (“we”, “us”, “our”) supplies products (“Products”) to you, our customer, via our website www.gather-store.com (“the Site”) or in person at our pop-up events and workshops. 

By placing an order with us, you agree to be bound by these Terms. If you do not agree, please do not place an order. 

We may update these Terms from time to time without prior notice. Changes will not affect any order we have already accepted.

Any day other than a Saturday, Sunday, or public holiday in England. 

Working Hours 

9:00 am to 5:30 pm UK time on a Business Day. 

Consumer 

An individual acting for purposes wholly or mainly outside their trade, business, craft, or profession. 

  1. Clause headings are for convenience only and do not affect interpretation. 

  1. Words in the singular include the plural, and words in the plural include the singular. 

  1. References to a gender include all genders. 

  1. References to a 'person' include natural persons, companies, partnerships, and other legal entities. 

  1. References to legislation are references to that legislation as amended, extended, re-enacted, or replaced from time to time. 

  1. If any part of these Terms is found invalid or unenforceable, the remaining parts will continue in full force and effect. 

  1. Business Customers 

  1. Where you are purchasing Products wholly or mainly for use in connection with your trade, business, craft, or profession (whether you are an individual or a corporate entity), you will not have the rights set out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. 

  1. In such cases, we will not be liable for any loss of profit, business, goodwill, or indirect or consequential loss, and our liability will be limited to the price paid for the Products.

  1. Eligibility and Use of the Site 

  1. You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. 

  1. You agree not to misuse our Site, interfere with its operation, or copy/reproduce any content without our permission. 

  1. Acceptable Use and Website Access 

  1. You must not use the Site in any way that breaches applicable laws or regulations, or that is fraudulent or harmful. 

  1. You must not knowingly introduce viruses, trojans, worms, or other harmful material to the Site, attempt to gain unauthorised access, or attack the Site in any way. 

  1. We do not guarantee that the Site will be secure or free from bugs or viruses, and you are responsible for configuring your devices and using your own virus protection software. 

  1. Intellectual Property 

  1. All content on the Site, including text, images, logos, product descriptions, and design, is owned by or licensed to us and is protected by copyright, trade mark, and other intellectual property laws. 

  1. You may not copy, reproduce, distribute, display, or create derivative works from our content without prior written permission. 

  1. Our Contract With You 

  1. You place an order online via the Site by following the checkout process and clicking 'Purchase'. 

  1. Once you submit your order, you will receive an email confirmation (this is not ‘acceptance’ of your order). 

  1. If your order is accepted, a contract is formed when we send you a Dispatch Confirmation email with your tracking number. Our contract together is formed when you receive this email. 

  1. We will notify you if we cannot accept your order. 

  1. We reserve the right to reject any order prior to acceptance without prior notice or reason. 

  1. Purchases Made In Person 

  1. Purchases in person are not covered by the Consumer Contracts Regulations (no automatic right to cancel). 

  1. We may offer an exchange or credit note within 14 days if goods are unopened, unused, in original condition, with proof of purchase. 

  1. Faulty or misdescribed goods purchased in person remain covered under the Consumer Rights Act 2015. 
     

  1. Price and Payment 

  1. Prices are in GBP (£). We are not VAT registered. 

  1. We may change prices at any time, but accepted orders will not be affected. 

  1. We accept payment via PayPal and major debit/credit cards through Shopify Payments. 

  1. Delivery 

  1. Products will be delivered to the address provided at checkout. 

  1. All orders must be signed for on delivery. In the event our courier cannot deliver to your address, they will leave instructions on how to arrange re-delivery, or, re-delivery in accordance with their notified instructions. You are responsible for arranging re-delivery with the courier directly. 

  1. If re-delivery fails and goods are returned to us, we may cancel your order and refund the product price (excluding delivery costs). 

  1. Risk, Ownership, and Statutory Rights 

  1. Responsibility for the Products passes to you once delivered and signed for, or, when the courier delivers to your nominated location.  

  1. Ownership of the Products passes only when full payment has been received. 

  1. Your statutory rights are not affected. 

  1. Your Rights to Cancel 

  1. You may cancel your online order within 14 days of receipt under the Consumer Contracts Regulations. 

  1. You must notify us by email before returning goods to obtain a Returns Number. 

  1. Goods must be unused, unopened, in resalable condition, with original packaging and seals intact. 

  1. For hygiene reasons, opened fragrances or cosmetics cannot be returned unless faulty. 

  1. You are responsible for return costs unless the goods are faulty or misdescribed. 

  1. Faulty or Damaged Goods 

  1. If goods are faulty, you are entitled to a full refund within 30 days of delivery. 

  1. After 30 days, you may be entitled to a repair or replacement. 

  1. If goods are damaged in transit, please retain all packaging and notify us immediately. 

  1. Returns Procedure 

  1. Regardless of your reason for requesting a return, contact us at info@gather-store.com for return instructions and to obtain a Returns Number. Returns may not be accepted, or may incur processing delays, without a Returns Number being included clearly in the returns packaging. 

  1. Returning goods because they are Faulty. If you are returning goods to us because they are faulty, we will send you a pre-paid shipping label for your use. We will not pay for return shipping otherwise. 

  1. Returns for all other reasons. Returns for any other reason than as described under Clause 14.2 must be paid for by you. Goods shall remain your responsibility until confirmed received back at our returns address. We strongly recommend using a tracked, insured shipping service. We are not liable for any goods until we have confirmed their receipt, or their receipt has been confirmed by the courier at the nominated returns address. 

  1. Refunds will be issued to the original payment method within the stated timescales. 

  1. Our Liability 

  1. We are not liable for business losses, loss of profits, goodwill, or indirect losses. 

  1. Nothing excludes liability for death or personal injury caused by our negligence, or fraud. 

  1. Accuracy of Information and Product Descriptions 

  1. We make every effort to ensure accuracy of descriptions, images, and details. 

  1. Fragrance descriptions are subjective; perception varies by personal preference, body chemistry, and environment. 

  1. Minor variations in packaging or presentation not affecting quality or performance are not defects. 

  1. Colours may vary depending on your device display. 

  1. If you believe there is a material error, please notify us. 

  1. Ingredients for all Products are provided on the packaging and/or the Site. It is your responsibility to review these and avoid any known allergens. We recommend performing a patch test before use. A skin reaction or allergy does not mean a Product is faulty where the Product has been supplied as described and the ingredients disclosed. We are not liable for allergic reactions, sensitivities, or similar responses, except where required by law. 

  1. Events Outside Our Control (Force Majeure) 

  1. We are not liable for delays or failures caused by events outside our reasonable control. 

  1. Governing Law 

  1. These Terms are governed by English law. 

  1. Any disputes will be subject to the jurisdiction of the English courts.

Frequently asked questions
What is your return policy?

In the event of a change of mind we will give you a refund as long as the product is unopened and in its original condition (with the cellophane and stickers intact where applicable) within 14 days of receiving your order. You will be responsible for any costs incurred for returning a product.

Do you sell samples of the fragrances?

Currently this not a service that we offer. However, orders placed will receive a 1ml sample to try where possible, or a sealed blotter of the matching fragrance to get a good feeling of the fragrance before opening the full size product.
When will I get my order?

We aim to wrap, pack and send your parcel within 48 hours of accepting your order online. Once Royal Mail has your parcel we will send you the tracking information and is sent Tracked 24 or 48.
Are your fragrances authentic and safe?

As avid lovers of fragrance and having worked in the industry for many years, you can rest assured we work with highly respected distributor partners and fragrance houses directly.

If you have a concern about safety of any products we stock, we refer you to check the ingredients list on each brands website. If you have a known health concern, please consult your doctor in the first instance. We are not held responsible for any reactions you might have.

My fragrance doesn't smell how I thought it would

We provide you with a matching 1ml vial or blotter of your chosen fragrance/s. This allows you to experience it on skin, or if a blotter gives you a very good impression of the final drydown experience. Fragrances will develop and change over time in combination with varying factors such as skin chemistry, diet, temperature.

This does not make your product not fit for purpose.
